This Privacy Policy (“Policy”) applies to Lens Distortions, LLC (“Lens Distortions”), a Nebraska limited liability company, and governs the collection, use, disclosure, and protection of information obtained through the Lens Distortions website located at lensdistortions.com, affiliated sub-domains, affiliated websites, the Lens Distortions mobile application, and all related products and services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read and understand this Policy.

Your use of the Services is governed by the Lens Distortions Terms of Service, which are incorporated into this Policy by reference. By accessing or using the Services, you acknowledge that you have read and understand this Policy.

This Policy applies to all information collected through the Services, whether collected directly from you or obtained from third-party sources as described herein. If you do not agree with the practices described in this Policy, you should discontinue use of the Services.

Lens Distortions may provide supplemental privacy notices for specific products, features, or services. Where a supplemental notice applies, it will be made available at or before the time of data collection and should be read together with this Policy.

III. INFORMATION WE COLLECT

Lens Distortions collects the following categories of information through the Services.

A. Account and Contact Information

Lens Distortions collects your first and last name, email address, mailing address, and company name (“Contact Information”) when you submit information through forms, create an account, make a purchase, or sign up for marketing communications.

B. Purchase and Transaction Information

Lens Distortions collects information about products or subscriptions purchased, subscription duration, and the date and time of purchases when you place orders or maintain subscriptions.

C. Payment Information

Credit card numbers, expiration dates, CVVs, and billing addresses are collected directly by third-party payment processors and mobile application stores. Lens Distortions does not store full payment card information on its servers.

D. Device and Usage Information

Lens Distortions automatically collects date and time of visits, length of visit, pages visited, IP address, geographic location, device type, browser, operating system, referring URL, and device identifiers. Session interaction data (clicks, scrolls, mouse movements) is collected through analytics tools. The mobile application may request access to your photo gallery for photo editing functionality.

E. Advertising and Tracking Data

Information is collected through advertising pixels and tracking technologies. This data may include browsing behavior, ad interactions, and conversion events. Lens Distortions may upload customer email lists to advertising partners for audience matching and lookalike targeting. See Section VII for opt-out rights.

F. Information from Third-Party Sources

Lens Distortions may obtain contact information (such as email addresses, job titles, and company information) from third-party data providers for sales and marketing outreach. Lens Distortions may also receive information about you from social media platforms if you interact with Lens Distortions through those platforms.

IV. HOW WE USE YOUR INFORMATION

Lens Distortions uses the information collected through the Services for the following purposes:

• Fulfill product orders and manage subscriptions.
• Provide customer support.
• Send marketing communications, including product updates, tips, and promotional offers.
• Deliver targeted advertising through advertising networks, including through audience matching and lookalike targeting.
• Analyze and improve the Services, including tracking usage patterns and diagnosing technical issues.
• Detect fraud, prevent unauthorized access, and maintain the security of the Services.
• Conduct sales outreach to prospective customers using information obtained from third-party data providers.
• Comply with legal obligations, enforce agreements, and protect the rights of Lens Distortions.

V. HOW WE SHARE YOUR INFORMATION

A. Service Providers

Lens Distortions shares information with third-party service providers that perform services on its behalf, including hosting and infrastructure providers, payment processors, email marketing platforms, customer relationship management providers, customer support platforms, transactional email providers, analytics and reporting services, cookie consent management providers, tag management services, and security and bot detection services. These service providers are authorized to use your information only as necessary to provide services to Lens Distortions and are contractually obligated to protect your information.

B. Advertising Partners

Lens Distortions shares information with advertising networks and platforms for targeted advertising, audience matching, and campaign measurement. Information shared may include identifiers (such as email addresses, device IDs, and cookie data), browsing behavior, and purchase activity. Under California law, this activity may constitute “sharing” of personal information for cross-context behavioral advertising. You may opt out of this sharing as described in Section VII.

C. Contact Enrichment Providers

Lens Distortions may share limited information (such as names or email addresses) with third-party data enrichment providers to obtain additional business contact information for sales and marketing purposes.

D. Legal and Compliance Disclosures

Lens Distortions may disclose your information: (i) pursuant to judicial or law enforcement subpoenas, warrants, requests, or orders, or to comply with applicable law; (ii) where Lens Distortions believes an individual’s rights, property, safety, or security is at risk; (iii) to establish or exercise legal rights or defend against legal claims; or (iv) where otherwise required or permitted by applicable law.

E. Business Transfers

If Lens Distortions is acquired by or merged with another entity, or if Lens Distortions sells substantially all of its assets, your information may be transferred as part of that transaction. The acquiring entity will assume the rights and obligations described in this Policy.

VI. COOKIES AND TRACKING TECHNOLOGIES

A. What Are Cookies

Cookies are small data files placed on your computer or device. Lens Distortions and its third-party partners use cookies and similar technologies (web beacons, pixels, SDKs) to collect information about your use of the Services.

C. Mobile Application

The Lens Distortions mobile application uses analytics and error-reporting SDKs for usage tracking and performance monitoring, and advertising-related SDKs for campaign measurement. The mobile application does not deliver advertisements. The application respects platform-level privacy controls where available.

D. Your Cookie Choices

• Cookie Banner: Where required by applicable law, Lens Distortions provides a cookie consent banner. Through this banner, you may accept or reject non-essential cookies before they are placed on your device. If you are not presented with a cookie consent banner, you may manage your cookie preferences through your browser settings, through Global Privacy Control, or by visiting the Your Privacy Choices page on the Lens Distortions website.
• Global Privacy Control (GPC): Lens Distortions honors GPC signals. When a GPC signal is detected, non-essential tracking technologies are suppressed.
• Browser Settings: You may manage cookies through your browser settings. Disabling cookies may affect your ability to use certain features of the Services.
• Google Analytics Opt-Out: You may opt out of Google Analytics by downloading the Google Analytics Opt-Out Browser Add-On at https://tools.google.com/dlpage/gaoptout/.

VII. YOUR PRIVACY RIGHTS (UNITED STATES)

This section applies to residents of states with applicable consumer privacy laws, including California, Virginia, Colorado, Connecticut, and other states with similar legislation. Lens Distortions provides the rights described below to all United States residents, regardless of state of residence.

A. Your Rights

• Right to Know/Access: You may request that Lens Distortions disclose the categories and specific pieces of personal information collected about you, the sources of that information, the purposes for collecting or sharing it, and the categories of third parties with whom it is shared.
• Right to Delete: You may request deletion of personal information Lens Distortions has collected, subject to exceptions permitted by law. Copies of your information that exist in backup or archival systems will be deleted or anonymized in accordance with Lens Distortions' standard backup retention schedule.
• Right to Correct: You may request correction of inaccurate personal information.
• Right to Opt Out of Sale or Sharing: You may opt out of the “sharing” of your personal information for cross-context behavioral advertising, as described in Section V.B.
• Right to Opt Out of Targeted Advertising: You may opt out of the use of your personal information for targeted advertising.
• Right to Non-Discrimination: Lens Distortions will not discriminate against you for exercising your privacy rights.

B. How to Exercise Your Rights

• Email Lens Distortions at [email protected] with a description of your request;
• Visit the Your Privacy Choices page at lensdistortions.com/privacy/sharing/, also accessible through the "Your Privacy Choices” link in the footer of the Lens Distortions website; or
• Enable Global Privacy Control (GPC) in your browser, which Lens Distortions honors as a valid opt-out signal.

C. Verification.

Lens Distortions may verify your identity before fulfilling a request by asking you to provide your name and the email address associated with your account.

D. Authorized Agents.

You may designate an authorized agent to submit a request on your behalf. Lens Distortions may require proof of authorization and may contact you directly to confirm.

E. Response Timeframe.

Lens Distortions will respond to verifiable requests within forty-five (45) days of receipt. If additional time is needed, Lens Distortions will notify you of the extension and the reason for it.

F. Categories of Personal Information Shared for Advertising.

In the preceding twelve (12) months, Lens Distortions has shared the following categories of personal information with advertising partners for cross-context behavioral advertising:

• Identifiers (email addresses, device identifiers, cookie data)
• Internet or electronic network activity information (browsing behavior, ad interactions)
• Commercial information (purchase history)

Lens Distortions does not sell personal information for monetary consideration. Lens Distortions does not have actual knowledge that it sells or shares the personal information of consumers under sixteen (16) years of age.

VIII. YOUR RIGHTS UNDER THE GDPR AND UK GDPR

This section applies to individuals located in the European Economic Area (EEA) or the United Kingdom whose personal data is processed under the General Data Protection Regulation (EU) 2016/679 (“GDPR”) or the UK General Data Protection Regulation (“UK GDPR”).

A. Data Controller

Lens Distortions, LLC is the data controller for personal data collected through the Services. Contact information is provided in Section II.

B. Legal Bases for Processing

• Contract Performance (Article 6(1)(b)): Processing necessary to fulfill orders, manage accounts, provide customer support, and deliver purchased products or services.
• Legitimate Interest (Article 6(1)(f)): Processing necessary for analytics, fraud prevention, service improvement, and internal business operations.
• Consent (Article 6(1)(a)): Processing based on your consent, including marketing communications and placement of non-essential cookies. You may withdraw consent at any time as described below.

C. Your Rights

Subject to applicable law, you have the right to: access, rectification, erasure, restriction of processing, data portability, objection to processing based on legitimate interests or direct marketing, and withdrawal of consent. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

D. Right to Lodge a Complaint

If you believe your data privacy rights have been violated, you have the right to lodge a complaint with the supervisory authority in your country of residence. Lens Distortions encourages you to contact Lens Distortions first so that it may attempt to resolve your concern.

IX. INTERNATIONAL DATA TRANSFERS

Lens Distortions is located in the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States, which may not provide the same level of data protection as your country of residence.

Where required by applicable law, Lens Distortions uses appropriate safeguards for international data transfers, which may include standard contractual clauses, data processing agreements, or other mechanisms designed to help ensure that your personal data is protected in accordance with applicable data protection laws.

By accessing or using the Services from outside the United States, you acknowledge that your information will be transferred to, stored in, and processed in the United States. X. DATA RETENTION

Lens Distortions retains personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. The criteria used to determine retention periods include:

• Account and Contact Information: Retained for the duration of your account. If you have not made a purchase, your account information will be deleted two (2) years after your last activity. If you have made a purchase, your account information will be retained as long as necessary to support Lens Distortions' ongoing warranty and licensing obligations related to that purchase, and for legal and business purposes.
• Purchase and Transaction Information: Retained as required by applicable tax, accounting, and legal obligations.
• Payment Information: Retained by third-party payment processors in accordance with their own policies. Lens Distortions does not retain full payment card information.
• Device and Usage Information: Retained in accordance with the default retention settings of the applicable analytics tools.
• Advertising Data: Retained by advertising partners in accordance with their own retention policies.
• Anonymized or Aggregated Data: Lens Distortions may retain anonymized or aggregated data indefinitely, as such data cannot be used to identify you.

XI. CHILDREN

The Services are intended for users who are at least eighteen (18) years of age. Lens Distortions does not knowingly collect personal information from children under the age of thirteen (13). If Lens Distortions becomes aware that it has collected personal information from a child under the age of thirteen (13), Lens Distortions will take steps to delete that information promptly.

XII. SECURITY

No method of transmission over the Internet and no method of electronic storage is completely secure. Accordingly, Lens Distortions cannot and does not guarantee the absolute security of your personal information and cannot assume liability for improper access to it.

You are responsible for restricting access to your computer or mobile device through which you access the Services. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to the Services. By using the Services or providing personal information to Lens Distortions through any means, you agree that Lens Distortions may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services.

The Services may contain links to websites, applications, or online services that are not owned or controlled by Lens Distortions. Lens Distortions does not necessarily review or endorse the content, privacy practices, or terms of use of these third-party websites or services.

This Policy applies only to information collected through the Services. Lens Distortions is not responsible for the privacy practices or the content of any third-party websites or services linked from the Services. When you follow a link to a third-party website, you are subject to that website’s own privacy policy and terms of service.

Lens Distortions encourages you to review the privacy policies and terms of service of all third-party websites you visit before providing any personal information to those websites.

XIV. CHANGES TO THIS POLICY

Lens Distortions reserves the right to modify this Policy at any time in accordance with applicable law. Any revised version of this Policy will be posted on this page, and the “Updated” date at the top of this Policy will be changed to reflect the date of the most recent revision.

For material changes to this Policy, Lens Distortions will notify you by email at the email address associated with your account. Your continued use of the Services following the posting of a revised Policy constitutes your acknowledgment of the changes.
